The Impact of the Achmea Ruling on European ISDS
In 2018, the Court of Justice of the European Union (CJEU) adjudicated the case of Slovak Republic v Achmea B.V. (Case C-284/16). In this case, it called into question the validity of arbitration agreements as part of bilateral investment treaties (BIT), with broad implications on all intra-European Union (EU) BITs. In 2019 the member-states of the EU signed a joint declaration on the legal impact of Achmea and would in 2020 sign the Agreement for the Termination of Bilateral Investment Treaties Between the Member States of the European Union.

The Politics of Civilization in the 19th Century

I will primarily be focusing on the respective declarations of war as demonstrative of the countries’ respective understanding of international law.
